what you buy from me, what you do not, and what happens if you change your mind. written to be read, not skimmed.

1.immediate access and your 14-day right of withdrawal

what you buy is digital content and a digital service: access to channels in the niche discord, delivered the moment you pay.

you give up the 14 days only if, at checkout, you tick a box of its own that says in these words that you ask me to start delivery immediately and that you accept losing the right of withdrawal (directive 2011/83/eu, art. 16(m); codice del consumo, art. 59 letter o). a general "i accept the terms" box is not that box and costs you nothing: if that is all you ticked, you keep your 14 days.

on the monthly plans this covers only what has already been delivered: if you withdraw inside the 14 days you pay for the days you had and i give back the rest (codice del consumo, art. 57 comma 3).

if you are a consumer in the eu and you were not asked to tick that box, you keep your 14 days: write to matteoabati054@gmail.com within 14 days of the purchase and you do not have to explain why, and you get back what you paid. you can use these words: to matteo abati, matteoabati054@gmail.com: i withdraw from my purchase of (product) made on (date); (your name, the e-mail you used on whop, today's date).

as of the date at the top of this document the whop checkout does not show that box for any of my plans: everyone buying from today keeps the 14 days. if that changes i post it in the server and this date changes.

monthly plans renew every 30 days until you cancel from your whop account; you keep access to the end of the period you paid for.

2.who you are buying from

matteo abati, sole trader (persona fisica), italy, matteoabati054@gmail.com; on discord, matteo in the niche server (discord.gg/2zUCdUrjjk).

all three products are paid on whop.com: the mentorship and the signal room from their checkout, the 1of1 from a private whop link i send you once we have agreed it in writing (section 3). whop processes the payment, issues the receipt and, depending on the tax mode set on my account, collects the tax on the transaction. i am the seller of what you get: the content, the access, the delivery and any refund are between you and me, under these terms. whop's own buyer terms apply to the payment itself.

3.what you are buying

three things are for sale. the 1of1 includes the mentorship; otherwise none of them includes another.

mentorship — eur150 a month, or eur500 once. access to the premium channels in the niche discord: the lessons, the breakdown channel, my notes, my models and strategies, the psychology channel, the premium vocal chat (live almost every new york and asia session), my dms (an answer within a couple of days, not a live desk), and my bot answering from my material in those channels.
signal room — eur150 a month. access to the signals channel and its chat: my levels on nq and other futures, across the asia and new york sessions, with take profit and stop, published to everyone in the channel at the same time. on average two or three levels a session; some days none. no lessons, no calls, no dms. the risk-reward i work with (1:10 minimum, 1:15 on average) is the target ratio between the stop and the take profit i set on each single level when i publish it, not a realised result: whether a level reaches its target depends on the market, and realised results change with the month, bad months included.
1of1 — from eur1,000. one-to-one work with me. it is not a package. it starts with a free call with me, which you book on cal.com. if it fits, i e-mail you what it covers, how long it runs and the price; if you want it, you reply "i agree", and that agreement is part of these terms. then i send you a private whop link for the amount we agreed: paying it also opens the premium channels of the mentorship.

the mentorship and the signal room are separate products at the same price. the signal room is not a step below the mentorship and does not turn into one.

my bot is a piece of software trained on my lessons and my breakdowns. in the premium channels it answers from my material; in the free channels of the server it answers about what i sell and how the server works. it can make mistakes, and it does not tell you whether to take a trade. what it cannot answer, it hands to me.

4.what you are not buying

everything i sell is educational. i am not a financial adviser and i am not authorised to give investment advice. nothing i sell is investment advice, portfolio management, or a recommendation addressed to you personally: the levels in the signal room are my own read of the market, published to everyone at once, not sized for your account and not matched to your capital or your situation. the same goes for my dms, for 1of1 work and the call before it, and for my bot.

i do not trade your account, i do not hold your money, and i never ask for broker or prop firm credentials. if you get a message from "me" asking for them, it is not me.

nobody can promise you a result, and i do not. what you buy is a method for reading the market and access to the person using it. the risk of every trade you take stays yours. the payout screenshots and the numbers on the site are individual results, not typical ones, and not an indication of what you would get. most people who trade lose money. read the risk disclosure before you buy: it is posted with these terms in the terms-of-service channel of the niche discord (discord.gg/2zUCdUrjjk), as a pdf you can save.

5.price, tax and billing

prices are set in euro. whop may show and charge them in the currency of the country you buy from. the final amount, in that currency and with any tax that applies where you live, is shown on the whop checkout page before you confirm, and that is the amount you pay.

the monthly plans renew every 30 days until you cancel. you cancel from your whop account, on your own, at any time, with no notice period; you keep access until the end of the period you already paid for, and nothing is charged after that.

the eur500 mentorship payment is made once. it does not renew and it does not expire: access for as long as the server exists. if i ever close the server, or the premium channels for good, i will say so in the server at least 30 days before, and i refund the unused part of what you paid at the closing day, counted as section 6 says.

if a renewal payment does not go through, your access ends with the period you already paid for. i do not charge you anything outside whop, the 1of1 included: you pay it from the private whop link, for the amount we agreed in writing.

6.refunds

every case in which money comes back is in this section. access is delivered the second you pay, so the 14 days of section 1 come first: if you are a consumer in the eu and you were not asked at checkout to give up the right of withdrawal, you have those 14 days on what you bought, whatever the list below says. after them, or if you gave that right up at checkout:

monthly plans: no refund on a month already started. you cancel the renewal instead, at any time, and you keep access to the end of the period you paid for.
eur500 one-off: no refund after access has started, except in the cases below.
1of1: what we agreed in writing before you paid. it is a service, so if you are a consumer in the eu or the uk the 14 days of section 1 stay whole on it, whatever the whop link shows: if you asked me in writing to start inside them and then withdraw, you pay only the part already done and get the rest back.
always refunded: you paid and the role never arrived, you were charged twice, or i charged you for something you did not buy. write to matteoabati054@gmail.com and it gets fixed, in full.
under 18: the access ends and the whole payment is returned (section 7).
the unused part comes back if i close the server or the premium channels for good (section 5), and if i remove you for a rule outside the list in section 9.

the unused part is counted this way: on a monthly plan, the days of the period you paid for that you did not get; on the eur500 payment, the part of the twelve months after that payment that you did not get; if the closing day falls later than those twelve months, i refund the part of the last twelve months you did not get.

when a refund is due i pay it within 14 days of hearing from you, to the same means of payment you used, at no cost to you.

nothing here limits the rights the law gives you where you live, including the right to dispute a charge with your card issuer.

7.who can buy

you must be 18 or older, and able to enter a contract where you live. buying for someone else, or sharing a seat, is not allowed. if i find out a member is under 18 the access ends and the payment is returned.

8.your access and the material

the lessons, the notes, the models, the breakdowns, the levels and everything else i post in the premium channels are mine. you get a personal, non-transferable licence to use them for your own trading and your own learning, for as long as your access lasts.

you cannot record, screenshot to repost, copy, resell, share, or feed to another service anything from the premium channels, and you cannot pass your access to someone else. one account, one person. what you post in the server stays yours. by posting it you let me and the other members see it there, and you let me show it on the site and on my socials as proof of what happens here, the way section 7 of the privacy policy describes: identifying details pixelated, taken down when you ask.

9.behaviour in the server

no recording, reposting, copying, reselling or scraping of anything from the premium channels, no bots of yours, no harassment, no threats, no hate speech, nothing sexual involving minors, no promoting other services in the channels, no impersonating me. the server rules posted in the discord are part of these terms.

if you promote my products for a commission (whop affiliate link or code), you say so in every post, story or message where you do it, in plain words, and you make no claim about results. i can end the affiliation and remove the content if you do not.

i can remove your access for breaking any of this. no refund is due for the period already started if i remove you for recording, reposting, copying, reselling or scraping anything from the premium channels, bots of yours, harassment, threats, hate speech, anything sexual involving minors, promoting other services, or impersonating me. if i remove you for any other rule, i refund the unused part of what you paid.

if you open a chargeback without writing to me first i answer it with the evidence i have. the right to dispute a charge with your card issuer stays, and using it does not cost you your access or the period you paid for.

10.what i answer for

i answer for delivering what section 3 lists, with reasonable care, and the legal guarantee of conformity for digital content and digital services (codice del consumo, art. 135-octies and following) applies to what you buy. i do not answer for your trading decisions and their outcome, for the markets, for the rules and decisions of any prop firm or broker, or for discord and whop being down when you want them.

if you are not a consumer, my liability is limited to what you paid me in the twelve months before the claim. in every case, nothing in these terms excludes or limits liability for wilful misconduct, gross negligence, death or personal injury, or any liability that cannot be excluded under the consumer law of the country where you live.

11.when things change

the content grows and the channels change; that is the point. what does not change without notice is the price of a plan you already hold and what you already paid for. if i change these terms, the date at the top changes, i post it in the server, and the new text applies to purchases from that date and to renewals after it. if you do not like the new text, you cancel the renewal and the old text covers the period you paid for.

12.law, courts and complaints

these terms are governed by italian law. if you are a consumer, none of this takes away the protections of the law of the country you live in, and you can always bring a claim, and can only be sued, before the courts of the place where you live. for anyone who is not a consumer, the competent court is the one of my place of residence in italy.

if something goes wrong, write to me first: most things are sorted in one exchange. if we cannot settle a complaint between us, you can also use an alternative dispute resolution body; in italy the list is published by the ministry of enterprises (mimit.gov.it), and i will name the one i am willing to use if it comes to that. whop's resolution center is available for payment disputes as well.
